Victims Who’ve Suffered from Sexual or Physical Abuse at AirBnB® Rentals are Urged to Get a Free, Private Case Evaluation in Order to Seek Both Justice and Compensation

According to Bloomberg®, AirBnB® has managed to prevent sexual and physical assault victims at rentals across the country from public knowledge:

  • Several Ex-AirBnB® employees told officials that the rental-share company faces thousands of sexual-assault claims annually.
  • A recent investigation revealed that AirBnB® keeps many of the worst cases of physical and sexual assault out of the public eye.
  • The investigation also revealed that payouts, arbitration, and non-disclosure agreements (NDAs) have helped AirBnB® avoid scrutiny on safety issues.

Why AirBnB® Rental Assault Goes Largely Unchecked in the US

An investigation disclosed new details about how AirBnB® has used a combination of monetary settlements and legal tactics to avoid lawsuits and negative press dealing with a variety of safety problems, including:

  • Mandatory arbitration clauses
  • Nondisclosure agreements
  • Payouts to victims

The result, Bloomberg found, is that regulators, researchers, and the public have had little visibility into the scope of safety incidents involving Airbnb and that courts haven't had the opportunity to determine who should be held legally liable.

AirBnB®'s practices of reaching settlements to avoid lawsuits–either dealing with physical or sexual assault or other safety issues–has prevented courts from determining when and to what extent short-term rental-booking sites should be held liable for crimes involving its users or listings.

Only one sexual-assault case has been filed against AirBnB®because the courts said that the company hadn't done a thorough background check on the host–one who had previously been accused of physical or sexual assault in the past.

Specific Instances of AirBnB® Rental Abuse Are on the Rise

Each year, millions of consumers use AirBnB® to book stays in destinations across the country and around the world..

An Bloomberg® article highlights several alleged instances of sexual and physical assault that have taken place in AirBnB®-rented properties.*

The Bloomberg® report alleges that AirBnB® has created what the company refers to as a "black box team” that works behind the scenes to handle certain adverse situations–including sexual and physical assaults of guests.

  • For instance, the report told the story of an AirBnB® host in Barcelona that "plied two American women who’d booked a stay at his home with alcohol, then raped them".*
  • A woman who was allegedly assaulted in her AirBnB® on New Year's Eve after an intruder used a duplicate key to enter her apartment and physically and sexually assault her.*
  • AirBnB® spends approximately $50 million a year trying to avoid lawsuits with guests and hosts who've had bad experiences–one woman received a $7 million settlement after she said she was raped.
  • AirBnB® caught its first major scandal in 2011 after guests trashed a host's home
  • A fatal shooting in California, in 2019 forced the company to eliminate party houses and increase measures to keep both guests and hosts safe.

We believe that victims of sexual and physical assaults at AirBnB®-hosted rental homes– and the families that suffered with them–should be able to address AirBnB® and get the compensation and justice they deserve.
