The judge in the 3M® earplugs MDL granted summary judgment for the plaintiff in the upcoming bellwether trial for Steven Wilkerson who was seeking summary judgment on all 3M®’s: 

affirmative-learned intermediary;

superseding cause;

failure to mitigate;

open and obvious danger; and,

statute of limitations defense.

February 2022

A federal jury awarded $110 million in damages last month in response to lawsuits alleging that 3M® knowingly manufactured and marketed defective earplugs resulting in the hearing loss of two U.S. Army veterans.

November 2021

A federal jury in Texas awarded an Army soldier $13 million for severe hearing damage he alleges was caused by ineffective, faulty earplugs manufactured and marketed by 3M®.

January 2019

Over 1,000 defective earplug lawsuits have been filed against 3M® alleging that the company manufactured and marketed protective earplugs to the U.S. military that the company knew were defective.
